Rant About a Couple Random Things

The nudity policy on DA is complete shit. I don't think I can tolerate it for very long. I want to DO something about it. Everyone, let me know if you're interested in perhaps forming a group protest. The censorship is killing me.

Other than that, 217 was the best chapter in a while. I'm extremely saddened by the nature of Kimimaro's death. It was affrontingly tragic, every detail of it made me ache with pity. The poor, poor boy. The GaaraLee was effin adorable though. Gaara: LETS GO FLY ON CLOUDS OF SAND TOGETHER!! Lee: *GIGGLE* OKAY!!

I need sleep.

Yeah. I'm no expert on this but I think the policy is no blatantly exposed sexual organs nor bodifluids etc, which apparently label it as porn (regardless of how beautiful or soft the picture might be, i assume). You should be able to post legal-for-sex-age dominatix and gay bondage pictures and whatever I believe, as long as it is nothing that it "does not depict anything which could be defined as obscene by United States law". That would be what I stated above methinks. Given the fact that devART actually costs more than a small business to run, I am surprised that it has taken them this long to realise "oh crap, how about looking over clarifying the most unfortunate but nessescary rules before someone sues us and our artists asses to kingdom kong?" before now. . It is still sad though (all that graphic smut I now have to look elsewhere for! My lazybones aches. ;_;). >/

I agree with you 100% on that one. Some of the pictures out there that are.. more leaning towards the perverts in us all can actually be very beautiful and soft. But unfortunatly not everyone sees that. And when people complain they can always pull the chain of.

and what you mean about how long it is taking them. I pretty much figured they'd have most if not all the kinks out of DA within the first year.. and it's not bordering on it's 4th year? The Admins must be lazy or something *sighs*

What I meant was 'you should be able to post...' as in you ARE, as far as I understand. It is in fact what an admin told me when I asked. The softness and beauty of a picture can't and shouldn't be a part of the judging material when you decide if it is explict/porn/offensive material though. I mean, it IS just up to opinion and preference -and not to mention the skill of the artist. Problem is as always the definition.

Then, of course as always, you can still get reported and have to defend yourself. There are always borderline cases and different opinions on things. And zealous people. The phase it takes for new rules and shit to grow into a community is always damn turbulent ones. It seems as if DA mroe or less never allowed explict sexual material (porn) but never before bothered to hunt it down... until few months ago when they realised the danger of possible lawsuits, heh.

and ya. I think a lot of people were complaining. But the problem is DA is divided. you have the older mature artists who find the human body that of beauty and I have seen some very beautiful artwork of positions and stuff.. but it was more to look at the meaning of the picture rather than what the people were actuall doing.

then you have the DA members who are under 15 who think the world is all happy and pretty ponies ^^; and I think the new rules and stuff involve to them. I think Da is scared of a kid actually hiunting down and looking at a pr0n pic and their mother walks in, sees what is on the screen, and sues DA.


Bah I dunno if I jus sterotyped but that's how I feel ^^;

It's sad that people these days solve complications by jus.. Sueing them.

At first I was shock and scared of that possibility, too. But no. I don't beleive that. The new rules are, with few exceptions I think, all based on legal and control matters (the matters of mods and admins interpreting the rules as more harsh than not because they want to, is a compleatly different thing to be upset about. Stupid people. Everywhere. ><;;). Then there is the gratious(sp?) nudity rule that is just DA's own thing. It IS illegal to post under-aged sex pictures online in many places. It is or can be illagal to post material qualifying as pornogaphy on open communities sites even if under a 'mature' cut. It is defenitely illegal to post pictures of naked models without their consent, etc. So in reality DA is doing nothing really wrong (bothersome as it might still feel for us artists, feh). It is just a matter of delicate opinion... as always... which leads to heacdaches... as always.

OK. No really. SO SORRY for spamming your journal Soltian. I am shutting up now. @_@

What annoys me with the new policies is the censorship on erotic and pornographic art, since I don't see why such things should be innappropriate if proper precautions (as previously provided by the site) are taken. I don't have any intention of forcing explicit material on people who don't want to see it, but I also don't like the feeling of being surpressed of what I'm allowed to share. It's ultimately up to the moderators of the site I know, what they choose to allow on it, but I am paying for my service and feel I should have an opinion in how I get to use it.
After reading through the thread I now just want more details on the legal issues at hand...I was unaware that there were any, and if there's nothing DA can do about it I know I'd take it better...I'm just not used to thinking of what I draw as a criminal act, and it still makes me rather angry.

(By the way, neither of you need to be concerned with spamming, this kind of discussion is very helpful to me.)

Understand and feel the same. Must admit I really have no real clue about US law on this matter except for the basic ones about underaged models and child porn, but I have been told that regardless of laws, deviantART "never allowed explict material". Apparently they just forgot to highlight the paragraph in the rules or something. By "explict material" I assume they mean pornographic material. The problem is to define pornographic material from just erotic art. I'm guessing, from recent discussions etc, that the line is drawn by 'blatant show of sex, bodyfluids, etc'. Although porn can YES very much still be art, it is still a rather special and problematic form... I certainly wouldn't be surprised if there are laws regarding how you are allowed to distrubute it, really. Especially in the US. *chough*

Though I can see why DA don't want to ditribute porn. There are much nice and good porn on DA, but just think of all the g'damned "Here is me and my boyfriend fucking!" pictures that they would have to host if they did honestly allow everything. o.o;

Aw, i don't think you should worry about feeling like a criminal though, Soltian. Heh, as a private person you can always be plain art. The problem for deviantART is that they are big enough and circulate enough money wth their huge servers etc that they probably can be qualified as a sort of company. Hence why they suddenly have to watch their back for these things, either they like it or not.
